3 points to remember in a Tennessee personal injury claim

On Behalf of | Aug 6, 2024 | Personal Injury |

Suffering an injury due to another person’s negligence is a traumatic experience. This can occur because of events, such as car crashes or slip-and-falls. If someone else’s negligence caused the event, you may opt to pursue a compensation claim

There are several things that you should remember if you’re in this position. One of the most important is that you have very specific rights, but it’s up to you to ensure they’re upheld.

Medical care

You must get medical care for your injuries. This shows what the injuries were, how severe they were and that you tried to mitigate the damages through acceptable treatment options. It also ties the injuries to the event, partly through the date that you first obtained care.

Statute of limitations

In Tennessee, the statute of limitations for personal injury claims is one year. This means that from the date of the injury-causing event, you only have one calendar year to get the claim filed in court.

Financial damages

When you file a personal injury claim, you must be sure to seek all the damages that are related to the injury. This isn’t limited only to those that you already know about. It also includes those you may incur in the future.

It can be difficult for an average person to estimate the financial damages they don’t know about yet, so it’s beneficial to work with someone who’s familiar with these cases and can use previous personal injury claims to help them gather information to come up with a suitable amount for the damages.
